02Current Regulatory Status (In Process)
Next Capital is currently not a credit institution, nor an Electronic Money Institution (EMI), and does not yet operate as an authorized agent.
Next Capital Solutions, S.L. is currently in the process of registration in the Special Register of Agents of Electronic Money Institutions of the Banco de España, in order to operate in the name, on behalf of and under the responsibility of the electronic money institution SEFIDE E.D.E., S.L.U. ("SEFIDE"), authorized and supervised by the Banco de España under official registration number 6705.
Next Capital will act as an agent of SEFIDE, distributing its electronic money services in the name, on behalf of and under the responsibility of SEFIDE, in accordance with article 18 of Ley 21/2011, de 26 de julio, de dinero electrónico.
Therefore, until the definitive obtainment of the requisite authorization and registration from the Banco de España, Next Capital does not provide, offer, or market any type of payment service, issuance of electronic money, or collection of client funds. Any information about financial services on this website is purely informational and a presentation of a future project, subject to the relevant regulatory approval.
03Safeguarding of Client Funds
In accordance with article 9 of Real Decreto-ley 19/2018 and article 8 of Ley 21/2011, the funds received in exchange for the electronic money issued are kept segregated from the assets of the issuing institution and deposited in demand accounts opened with an authorized credit institution, in this case Banco Inversis, S.A. This segregation ensures that, in the event of the insolvency of SEFIDE E.D.E., S.L.U. ("SEFIDE"), an electronic money institution authorized by the Banco de España (registration no. 6705) under whose responsibility Next Capital will operate, or of the cessation of Next Capital's activity, the funds remain available to clients and are not merged with the balance sheet of the operating entities.
Right of redemption
In accordance with article 11 of Ley 21/2011, the holder of the electronic money has the right to redemption at its nominal value at any time. A fee may apply in the cases provided for in article 11 of Ley 21/2011, which will be reported to the client in advance in the terms of the service.
No deposit guarantee
Electronic money institutions are not covered by the Deposit Guarantee Fund for Credit Institutions, as they do not collect deposits within the meaning of Ley 11/2015. The protection of funds is articulated through the safeguarding regime described above.
04Supervision
The activity of issuing electronic money is subject to the prudential supervision of the Banco de España (article 16 of Ley 21/2011). Likewise, SEFIDE and Next Capital are subject to the regulations on the prevention of money laundering and terrorist financing (Ley 10/2010), under the supervision of SEPBLAC (Servicio Ejecutivo de la Comisión de Prevención del Blanqueo de Capitales e Infracciones Monetarias), the competent body for the prevention of money laundering and terrorist financing in Spain.
